This site is only for posting updates directly relating to the being able to use the Marston cycle path in Oxford, usually flooding information but occasionally other closely related issues such as lighting or path closures. It is not for wider discussions or for campaigning.

You must not post anything which is illegal under the laws in any part of the United Kingdom. You must not or use the service to facilitate or commit any offence under the laws in any part of the United Kingdom. This includes, in particular, terrorism content (as set out in Schedule 5, Online Safety Act 2023), child sexual exploitation and abuse content (as set out in Schedule 6, Online Safety Act 2023), and content that amounts to an offence specified in Schedule 7, Online Safety Act 2023. You must not post any content which is pornographic. This includes content of such a nature that it is reasonable to assume that it was produced solely or principally for the purpose of sexual arousal.

All content is copied to the administrator(s) who will take down any illegal or inappropriate content as quickly as possible. This applies in particular to any illegal content within the scope of the Online Safety Act 2023, including terrorism content, child sexual exploitation or abuse content, and any content that amounts to an offence specified in Schedule 7 of the act, and the administrator(s) will of course prioritise dealing with any such content.

Any inappropriate content can also be reported to the administrator(s) by emailing psychopath@urchin.earth.li, as can appeals about the removal of content.

The administrator(s) will take all decisions about removing content having regard to the nature and purpose of the site as described above, and reserves the right to do this for any content or to suspend or ban users from the site. An element of discretion may be applied but the administrator(s) are keen to avoid the site being a general discussion forum.

Contract

The Online Safety Act 2023 says that you have a right to bring a claim for breach of contract if anything that you generate, upload or share is taken down, or access to it is restricted, in breach of the terms of service, or you are suspended or banned from using the service in breach of the terms of service.

As this is a free service operated without generating any kind of revenue, nothing in this document is intended to create a contract, but obviously this would be for a court to decide.

We limit our liability to a refund of the amount of any payment(s) that we have received from you in respect of the service relating to the month in which the basis of your claim arose. To bring a claim under this section, you must serve us with a claim form issued by a court in England and Wales within 12 months of the date on which the basis of your claim arose. If any contract is found to be implied, all disputes arising out of, or in connection with it, are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales.
